Équipements Séguin et Frères, Inc. which markets Kuboda farm equipment has lost its bid to have a farmer’s appeal to the OMAFRA Appeals Tribunal dismissed.
The dealer argued that the tribunal lacks jurisdiction because the tractor was sold from a dealership located in Quebec.
The tribunal agreed with the lawyer for the farmer, Raymond Lalande, who argued that the dealership advertises in Ontario, is registered as a dealer under Ontario’s Farm Implements Act and conducts business with clients in Ontario.
