Tribunal denies government motion

The appeals tribunal has denied the Ontario Farm Products Marketing Commission’s attempt to avoid a hearing on its decision to allow Mac’s a one-year trial marketing fluid milk in three-litre jugs.

The OMAFRA Appeal Tribunal has said it will soon set a date for the appeal hearing to take place.

It’s the Ontario Dairy Council, which represents most milk processing companies in the province, that has filed the appeal.

Doesn't it warm the cockles of your heart to learn that the Ontario Dairy Council is so diligent in protecting your consumer interests? I mean, you really don't want all those nasty milk jugs on the market, do you?

After the commission granted Mac’s Convenience Stores Inc. its request for a one-year trial period to market jugged milk, two other companies expressed interest in doing the same -7-Eleven Canada, Inc., and Saputo.

The commission has asked both of them to submit formal requests in writing.

The commission has not approved test marketing of jugged milk to either 7-Eleven or Saputo.


The Ontario Dairy Council appeal has shelved the commission’s approval for Mac’s until the tribunal holds a public hearing and issues a decision.
