The legal sparring between Sweda Farms and Burnbrae Holdings
Inc. and its Maple Lynn Foods Limited division continues.
Burnbrae earlier won a court decision dropping it out of a
conspiracy lawsuit Sweda filed against it, L.H. Gray and Son Ltd. and the
Ontario Egg Producers Marketing Board.
Sweda appealed that decision and lost.
The court awarded Burnbrae court costs in these legal
battles and they were set at $540,000 plus interest.
Sweda refused to respond to Burnbrae’s initiatives to
collect, so Burnbrae went back to court.
In the decision from that case, there is evidence that
a trust sold quota for more than $14
million. The trust is also a priority creditor of Sweda
Farms and Burnbrae is having trouble collecting from Sweda.
It argues that the trust and Sweda are closely connected, so it should be able to collect. Principal Svante Lind was not answering questions to Burnbrae's satisfaction and that's why it went to court this time.
The judge has ruled that Lind must answer.
The question remains whether Sweda has the money to pay.

The judge added another $5,000 in court costs for this most
recent case.
Sweda’s lawyers are still not finished trying to get
Burnbrae back into the courts over issues raised in the conspiracy lawsuit.
They have also filed a $30-million lawsuit against lawyer Donald Good who was handling the conspiracy case.
