Stuart Jackson is appealing the dismissal of perjury charges
he has laid against Mary Jean McFall, a daughter of Joe Hudson who is Canada’s
largest egg farmer, largest egg grader and an egg processor.
She is also chief of staff for federal Agriculture Minister Lawrence MacAulay.
Jackson claims McFall lied in an affidavit filed in
connection with another lawsuit filed by Svante Linde and his Best Choice Eggs
business against Hudson and his Burnbrae Farms business.
Two judges have ruled that Jackson’s lawsuit has little
chance of ending in a conviction.
But Jackson’s lawyers say in their application for an appeal
that “McFall deliberately provided false evidence in a sworn
affidavit filed in a civil proceeding, thereby committing the offence of
perjury.”
They say that the argument that there
is “no reasonable prospect of conviction” flies in the face of “unequivocal,
corroborated evidence of perjury that was apparent and irrefutable on the face
of the record.”
The lawyers want the court to set
aside the decision made earlier this year and to lift the stay imposed in May of
2015.
And if the original case can’t go
ahead, they ask for the right to lay new charges and to apply to a judge for
permission to issue summons to obtain testimony and evidence.
