Basically, the Van Aert family said the marketing board’s pullet quota leasing rates were too high for BVA Farms Ltd., Del Van Farms Inc. and CJVA Farms Ltd.
The family wants to grow pullets to organic standards for its egg-production facilities.
It had built a costly new barn and needed more quota to achieve efficiency.
The tribunal’s original ruling was that the egg board had the right to set quota-leasing rates and the Van Aert family knew the risks when it embarked on its investments.
Now Katie DeBlock, vice-chair of the Ontario Ministry of Agriculture, Food and Rural Affairs Appeal Tribunal, has written “I find no material errors in law or fact in the Tribunal’s decision. The Request for Review is denied. “
