Burnbrae court date is Dec. 1

The Ontario Court of Appeal has set Dec. 1 at Osgoode Hall in Toronto to hear why Burnbrae Farms Ltd. ought not be let off the hook from the conspiracy case filed by Svante Lind and his Best Choice Eggs.

Joe Hudson’s lawyers succeeded in getting Burnbrae exempted from the case in court in Toronto earlier this year, but Lind appealed.

L.H. Gray and Son Ltd. failed in a similar attempt to have the lawsuit against it dismissed and has already lost its appeal.

The case has been before the courts since 2005 and in a nutshell is a complaint that Gray, Hudson and Harry Pelissero of the Egg Farmers of Ontario marketing board conspired to drive Best Choice out of the egg-grading business.


There is a long list of related complaints about cheating, price-fixing and market-rigging in the conspiracy case Lind has filed. Gray’s lawyers have denied any wrongdoing.
