The Ontario Agriculture, Food and Rural Affairs Appeal
Tribunal has ruled that the egg board followed proper procedures in consulting
quota holders about the rental policy and nothing it did contravenes any
provincial laws or regulations.
It also said Phoenix and two supporters, John Van Aert and
John Pilgrim, failed to provide convincing evidence that the board’s policy
will make egg farming less efficient and more costly and therefore impact the
pricing of eggs because it’s based on the industry’s cost of production.
The tribunal ruled against the egg board’s challenge that
too much time passed between adoption of the policy and the filing of the
appeal.
The tribunal noted that the rental policy, although it was
passed two years ago, didn’t take practical effect until a year ago.
